Rand Paul on fiscal cliff - Legal Insurrection

There isn?t going to be a vote tonight in the House, at least.

And it?s not clear what all the details are, but it looks as of this writing that taxes will go up on people making more than $400,000 individually or $450,000 as a couple. But beyond that, according to Rand Paul?s interview just moments ago, there may be more spending ? that?s right, more spending and no spending cuts.

Paul said although he doesn?t like the tax portion, he might vote for it because it protects 99% of the people, but he?s not going to vote for a bill that includes more spending.

Erika Menendez, Alleged Subway Pusher, Arrested For Hate Crime

FOREST HILLS ? A woman alleged to have killed a Woodside man waiting for a 7 train by pushing him into the path of an oncoming train Thursday was arrested with a hate crime Saturday, after she allegedly admitted to hating Muslims, according to the Queens District Attorney.

Erika Menendez, 31, of Rego Park, was recognized Saturday morning in Brooklyn by a person who had seen her in a surveillance video the NYPD released Friday night, police said.

After she was spotted on Bedford Avenue near Empire Boulevard, as the NY Daily News reported, the eyewitness dialed 911 to report the sighting. Patrolling officers on the scene confirmed the woman's identity, police said.

Taking her into custody, police brought her to detectives at the 112th Precinct for questioning, where she made statements implicating herself Saturday afternoon, police said, eventually confessing to the homicide.

?I pushed a Muslim off the train tracks because I hate Hindus and Muslims," she allegedly told police, according to charges filed by District Attorney Robert Johnson. "Ever since 2001 when they put down the Twin Towers, I?ve been beating them up.?

The DA charged her with murder in the second degree, as a hate crime, and if convicted, Menendez faces up to 25 years in prison, the office stated in a release.

Menendez was arraigned shortly before 11 p.m. Saturday, and held without bail, a spokesoman from Johnson's office said.

The brutal death of Sunando Sen, 46, came as a surprise to friends, who told DNAinfo.com New York that Sen had just opened his own copy shop in Manhattan, fulfilling a lifelong dream. They described him as a gentle, hardworking immigrant who had moved from Calcutta, India to Queens years before.

His friends were devastated about the death on Friday. "It's broken my heart," said Sen's roommate, M.D. Khan, 33.

Sen was waiting for the 7 train at the 40th Street station, near Queens Boulevard, when the woman, who had been mumbling to herself on the platform, approached him from behind and pushed him onto the northbound tracks as a train was pulling into the station, police said.

Menendez's defense attorney has requested a psychiatric evaluation of the alleged killer, the results of which will be presented in Queens Criminal Court on January 14.

The death came weeks after Ki-Suck Han, 58, was killed when he was pushed onto the Q train tracks at 49th Street in Midtown. Police arrested Naeem Davis, 30, who admitted to shoving Han, and later charged Davis with murder.

Defensive coordinator Todd Grantham has hinted that the hire could come soon after Georgia's meeting with the Nebraska Cornhuskers in the Capital One Bowl, but is still looking at several "quality candidates," he told Weiszer. Grantham is tasked with replacing former D-line coach Rodney Garner, who held the position for 15 years and coached All-American linemen Richard Seymour and David Pollock, in addition to current UGA standouts Geathers and John Jenkins, who will miss the Capital One Bowl after being ruled academically ineligible.

Geathers, a 6'6, 346-pound junior from Georgetown, S.C., has 37 tackles, five of which resulted in lost yardage, and one sack on the season.

As Biodiversity Declines, Tropical Diseases Thrive

Global health advocates often argue that the tropical diseases that plague many countries, such as malaria and dengue, can be conquered simply with more money for health care ? namely medicines and vaccines.

But a new paper is a reminder that ecology also has a pretty big say in whether pathogens thrive or die off. Using a statistical model, researchers predicted that countries that lose biodiversity will have a heavier burden of vector-borne and parasitic diseases. Their results appear this week in PLoS Biology.

"The general logic is that the more organisms you have out there, the more things there are that can interrupt the life cycle of disease, and the less concentration you'll have of any vector," Matthew Bonds, a researcher at Harvard Medical School and the lead author of the paper, tells Shots.

But plants, mammals and birds are disappearing fast ? one-third of the world's species are now threatened with extinction, according to the United Nations. And when the creatures that prey on mice, mosquitoes or other vectors of disease go, parasites and other disease-causing agents discover it's a lot easier to survive.

Scientists have already shown that's one reason for the explosion of Lyme disease in the Northeast United States. A 2002 paper in the Proceedings of the National Academy of Sciences found that if you have a rich community of tick hosts, like squirrels, mice and other small mammals, the disease is diluted among them. But if the habitat is degraded, and ticks carrying Lyme have only white-footed mice as hosts, the disease risk to humans can rise dramatically.

West Nile encephalitis, a mosquito-borne disease, has also ripped through communities with the help of surging bird populations, according to a study in Nature.

Because of studies like these, Bonds wanted to see how strong the causal relationship was between biodiversity and 12 common vector-borne and parasitic diseases on a global scale. So he chose statistical methods from a new field that blends economics and ecology called "macroecology" to figure out how biodiversity loss affected disease burden, controlling for several different variables.

Ultimately, he found that if a country with a relatively high biodiversity (such as Indonesia) were to lose 15 percent of it, the burden of disease would be expected to increase by about 30 percent. His models also showed how diseases have a significant impact on economic development and explain differences in income between tropical and temperate countries.

"I think what this shows is that the burden of disease is really important, and it's not just driven by health care," he says. "These diseases spend so much of their life-cycles outside of humans, so they're part of the physical environment."

Nevertheless, human disease is still generally viewed as a medical or public health problem ? not an ecological problem. Policymakers only just beginning to talk about conservation as they plan for public health.

Man pushed to death on NYC subway tracks

A man was pushed from a subway platform in Queens Thursday and killed by an oncoming train, a law enforcement official told NBC 4 New York.

Witnesses told police that a woman, described as heavyset and in her 20s, shoved the man onto the 7-train tracks at 40th Street and Queens Blvd. before fleeing, the law enforcement official said. Police are searching for the woman.

Police say they believe they have video of the suspect that they're currently retrieving from a pizzeria near the train station. The video was expected to be released overnight.

The suspect, dressed in a gray, white and blue jacket, had been mumbling to herself and pacing the platform, according to police. Witnesses said that the victim and suspect did not exchange any words and that it appeared that the man did notice the suspect at all before being pushed from behind to his death.

"I heard it. One of my customers was on train and heard it going over body," said Jiovanni Briones, who works near the scene.

It is the second time this month that a person has been shoved onto subway train tracks and killed.

Naeem Davis, a 30-year-old deli worker, was recently arrested and charged with second-degree murder for allegedly pushing a man off a Midtown subway platform to his death.

Unilever to phase out 'microplastics' by 2015

AMSTERDAM (AP) ? Unilever, the maker of Vaseline, Axe deodorants and Dove soaps, among other cosmetic and hygiene products, says it will phase out the use of microplastics by 2015.

Many soaps, skin scrubs and shower gels contain microplastics, which are tiny polyethelene beads. Scientists and environmental groups are concerned that they contribute to polluting oceans.

The company said Thursday that it has "decided to phase out the use of plastic micro beads as a 'scrub' material in all of our personal care products" by 2015.

Unilever is one of the world's largest consumer product companies, competing with Nestle SA and Procter & Gamble Co.

Retailers to recall 150,000-plus baby recliners

WASHINGTON (AP) ? Four national retailers agreed to recall more than 150,000 Nap Nanny baby recliners after at least five infant deaths and dozens of reports of children nearly falling out of the recliners, the Consumer Product Safety Commission said Thursday.

The recall covers Nap Nanny Generations One and Two, and the Chill model infant recliners. All were sold between 2009 and 2012. The Nap Nanny was designed to mimic the curves of a baby car seat, elevating an infant slightly to help reduce reflux, gas, stuffiness or other problems.

The CPSC warned parents and caregivers that the Nap Nanny contains defects in its design, warnings and instructions. The agency said the product poses a substantial risk of injury and death to infants.

The four retailers ? Amazon.com, Buy Buy Baby, Diapers.com and Toys R Us/Babies R Us ? agreed to voluntarily participate in the recall of the Nap Nanny because its manufacturer is unable or unwilling to participate, the government agency said in a statement.

The manufacturer, Baby Matters LLC of Berwyn, Pa., told The Associated Press earlier this month that it had gone out of business. At the time, the company's website carried a statement from owner and founder Leslie Gudel that the company didn't believe the CPSC complaint had merit and that its products were safe when used as instructed.

The first two versions of the foam recliner were recalled in July 2010 after the agency became aware of one death and 22 reports of infants hanging out or falling over the side of the Nap Nanny even though most of the infants had been placed in the recliner's harness. Since then, the agency learned of four more deaths. Four were linked to the first versions of the recliner, and one to the newer model.

Five thousand Nap Nanny Generation One and 50,000 Generation Two models were sold between 2009 and early 2012. About 100,000 Chill models have been sold since January 2011.

The CPSC advised consumers seeking more information about the recall to review the return policies of the retailers participating in the recall.

2012: The year malware surged 'dramatically'

December is "prediction season" in the cybersecurity industry. Every major anti-virus software maker and digital-security provider issues its own forecasts of what computer users face in the coming year.?

So far this month, the predictions for 2013 look a lot like those for 2012: more?Android malware, increased cyberattacks by nation-states and greater activity by "hacktivist" groups such as Anonymous.?

However, a few companies go back and check their own predictions at the end of the year to see what they got right ??and wrong.?

One company that does so is Moscow-based Kaspersky Lab, one of the top five anti-virus companies in the world.?

"In 2011, we really saw a number of things rising up: hacktivism; big?database breaches; attacks against Androids; attacks against Macs; data espionage became daily business in 2011," said Roel Schouwenberg, senior researcher at Kaspersky's Boston-area office. "When we look at 2012, we saw a further evolution of all these new trends."?

Kaspersky made the following predictions for 2012:?

  • Hacktivist?groups, who attack computer systems for political or social reasons, would continue to increase their activities?
  • A higher rate of "advanced persistent threat" attacks, or state-sponsored espionage efforts?
  • More incidents of cyberwarfare involving customized, state-sponsored malware?
  • Attacks on software and game developers such as Adobe, Microsoft, Oracle and Sony?
  • More aggressive actions from law-enforcement agencies against cybercriminals?
  • An increasing rate in the growth of threats to the Android mobile platform?
  • Successful attacks on Apple's Mac OS X computer platform?

Let's examine five of the top security incidents that shaped 2012 and check the accuracy of the Kaspersky researchers in light of those predictions.?

1. More Mac OS X malware
Security experts had anticipated an outbreak of malware targeting Mac OS X for years; 2012 was when it finally happened.?

The bug that did it, called the?Flashback or Flashfake Trojan, first appeared near the end of 2011, but didn't reach its peak rate of infection until March of 2012.?

Flashback infected more than 700,000 Macs around the world, the largest known Mac OS X infection to date.?

"In 2011, we predicted that we would see more Mac malware attacks," said Kaspersky Lab's Costin Raiu and David Emm in a?blog posting. "We just never expected it would be this dramatic."?

Why did Flashback wreak such havoc??

One reason was a well-documented Java vulnerability, which Apple took a long time to patch even after it had been publicly disclosed. The Flashback authors took advantage of Apple's delay to incorporate the Java exploit into their otherwise unremarkable creation.?

The second reason was the general?lack of awareness among Mac users?about security. Proper anti-virus software would have stopped Flashback's attack, yet most Mac users felt they didn't need it.?

Flashback wasn't the only successful attack on Mac OS X systems in 2012. There were multiple espionage-related attacks on Macs used by Tibetan dissidents and exiles. Some of the attacks used corrupted files purporting to?come straight from the Dalai Lama, Tibet's exiled leader.?

"The espionage angle may be a bigger factor for Mac right now than regular consumer malware," Schouwenberg said. "For general cybercrime, most criminals go after Windows because that's what they know. That's what's easiest for them."?

"But when it comes to these targeted attacks, the attackers go after whichever machines the targets are using. So if the targets are using Macs, they'll go after Macs."?

Schouwenberg said in terms of the proportion of available systems infected, Flashback was the most successful malware outbreak of the year.?

"When you look at relative market share, the Flashback malware in terms of prevalence was the size of [the infamous Windows worm]?Conficker," he said. "This was an absolutely huge event in the Apple world. When you extrapolate [the number of Macs infected] to Windows numbers, that's about 10 million."?

2. Cyberweapons: Flame??
Cyberwarfare is a term that often gets hyped up, especially when a politician or general is speaking.?

In fact, the?Stuxnet worm, which crippled an Iranian uranium-enrichment facility in the summer of 2010, was for nearly two years the only known cyberweapon that had destroyed anything.?

That changed this past spring, when a series of cyberattacks destroyed computer systems at oil facilities in Iran, as well as in the offices of the Iranian oil ministry.?

Wiper, the malware thought to be responsible for the attacks, was never found, although certain tell-tale signs indicated it was similar to Stuxnet and its cousin Duqu.?

During the investigation in May, however, researchers from Kaspersky, the Iranian computer emergency response team MAHER and the CrySyS Lab at Budapest University in Hungary discovered something else ?possibly the most sophisticated piece of malware ever seen. Kaspersky's team called it "Flame."?

The size, age and sophistication of Flame were startling. It was 20 megabytes in size, as large as a complex smartphone game, while most malware is only a few dozen kilobytes in size.?

Flame contained a dozen different modules that could be added and subtracted according to the task at hand, which made it extremely versatile as spyware.?

It could map out networks, index files, record audio and video, log keystrokes, take screenshots and archive emails and instant messages. When its job was done, it would destroy all signs of itself on any 32-bit Windows PC, and sometimes the host system as well.?

Yet despite its size, Flame was at least five years old at the time of its discovery ?an enormous amount of time for a piece of malware to be "in the wild."?

As?Raiu said in a press release, Flame was "an example of a complex malicious program that could exist undetected for an extended amount of time while collecting massive amounts of data and sensitive information from its victims."?

A couple of weeks after its discovery, Dutch researchers found that Flame's creators had pulled off a mathematical breakthrough.?

Using unknown techniques, Flame's creators had created a nearly-impossible?cryptologic collision?that allowed Flame to present itself as a signed, genuine Windows update package direct from Microsoft. No anti-virus software could have stopped it.?

?Gauss...?
In August, Kaspersky researchers found a highly sophisticated Trojan in the Middle East, this time spying on Lebanese banks.?

Like ordinary criminal banking Trojans, this new malware, which Kaspersky researchers dubbed "Gauss," stole online-banking credentials to break into accounts. Yet Gauss didn't steal any money ?just information.

In their year-end review, Raiu and Emmer said Gauss added a "new dimension to nation-state cyber-campaigns," even if it was nowhere as sophisticated as Flame.?

"It appears there is a strong cyber component to the existing geopolitical tensions ?perhaps bigger than anyone expected," they added.?

? and Shamoon?
That would prove to be an understatement. Later in August, Shamoon, a piece of especially destructive, yet simple, malware, made?its world debut.?

Named after a piece of text embedded deep in its code, Shamoon launched an attack against the state-owned Saudi Arabian oil company Saudi Aramco and destroyed data on more than 30,000 computers. ??

Shamoon was crude but effective. It searched an infected system for certain files, sent a list of those files to a remote server, and then methodically deleted key parts of the installed Windows system, rendering the infected machine useless.?

"You have the hacktivist movement claiming credit for that attack, which may or may not be the case," Schouwenberg said.?

"Shamoon wasn't really that sophisticated, but when you look at the relevance of the incidence, it's extremely, extremely important," Schouwenberg added, "especially when you consider the fact that Saudi Aramco announced just recently that they strongly believe that Shamoon's real target was to mess with the oil production rather than just sabotaging the machines in the corporate network."?

Kaspersky researchers said many details about Shamoon were still unknown, such as how the malware infected Saudi Aramco's systems in the first place, or who was behind the malware.?

Some observers suspect Iran created and used Shamoon as an attempt to cripple Saudi Arabia's oil production, which would cause oil prices to rise, benefiting cash-strapped Iran.?

3. Exponential growth in Android malware?
During 2011, there was an explosion in the number of?malicious threats against the Android platform. It was obvious that the trend would go on.?

Kaspersky, as well as most of its competitors, accurately predicted that the number of threats for Android would continue to grow at an alarming rate in 2012.?

"We predicted we would see an explosion in Android malware and that's what we saw," Schouwenberg said. "There is a huge amount of Android malware these days, although not anywhere near the amount of Windows malware that we see. But it's grown very dramatically."?

How dramatically??

"The number of samples we received continued to grow and peaked in June 2012, when we identified almost 7,000 malicious Android programs," Raiu and Emmer wrote. "Overall, in 2012, we identified more than 35,000 malicious Android programs, which is about six times more than in 2011."?

So why is there so much Android malware, and so little malware targeting its competition, Apple's iOS??

It's because?iOS is locked down tight. Apple oversees every part of the hardware and software development, and strictly controls which apps can be installed on iOS devices.?

Android, however, is a free-for-all. Dozens of manufacturers make hundreds of Android devices, and the operating system is a little different on each one. Manufacturers and cellular carriers?refuse to update Android?in a timely manner, resulting in security holes that are left unpatched for months or years.?

"Off-road" app markets flourish, especially in China where access to the official Google Play store is restricted. Google has belatedly tightened security in both Android itself and in the Google Play store, yet its efforts have a long way to go before they can match Apple's.?

Still, the tighter security in the latest versions of Android may be having an effect. Kaspersky's own figures show that while the number of new Android threats continued to grow in the second half of 2012, the rate of growth began to slow.?

4. Advanced persistent threats go quiet?
Advanced persistent threat hackers, i.e. cyberspies, were certainly active in 2012, yet didn't have the spectacular successes they'd had in previous years.?

Perhaps the most visible attack on Western targets was the discovery in September 2012 that two pieces of malware had been signed using a?valid Adobe code-signing certificate.?

Apparently, someone, somehow, had broken into an Adobe server and stolen authentication certificates.?

"This discovery belongs to the same chain of extremely targeted attacks performed by sophisticated threat actors commonly described as APT," wrote Raiu and Emmer. "The fact that a high profile company like Adobe was compromised in this way redefines the boundaries and possibilities that are becoming available for these high-level attackers."?

5. Data breach after data breach?
One thing that Kaspersky failed to anticipate in 2012 was the seemingly unending parade of huge data breaches involving companies and organizations with inadequate security.?

In early June, the business-networking website LinkedIn had?6.4 million passwords stolen. The passwords were encrypted, but in a very simple way that meant most could easily be deciphered.?

A day later, online-dating service eHarmony suffered a similar breach,?losing 1.5 million passwords, also poorly encrypted.?

In July, struggling Web giant Yahoo was embarrassed by a data breach that revealed?450,000 passwords?had been stored without any encryption at all. It wasn't entirely Yahoo's fault, since the database was acquired with the 2010 purchase of another company, but it was also evident that no one had bothered to check.?

Worst of all was the revelation in late October that vital personally identifiable information on?3.8 million adult residents of South Carolina, plus 1.9 million dependents and 700,000 businesses, had been stolen from the state tax agency.?

Entire tax records, containing names, addresses, dates of birth and, worst of all, Social Security numbers, were all stored unencrypted. Virtually the entire state population of 4.7 million people was put at grave risk of identity theft.?

Weeks after the breach was revealed, the state government was blaming the federal IRS for not providing strong security guidelines, and was itself being criticized by security experts for not revealing enough about what had happened.?

Looking back, and forward?
"There isn't too much that was shocking news over 2012, just these up-and-coming things [from] 2011 that really established themselves in 2012," Schouwenberg said. "But we also saw some examples of new nation-state [campaigns] like Flame and Gauss. But from my personal point of view, the most significant event of the year was Shamoon."?

As for 2013, "we expect the next year to be packed with high-profile attacks on consumers, businesses and governments alike, and to see the first signs of notable attacks against the critical industrial infrastructure," Raiu said in a company press release.?"The most notable trends of 2013 will be new examples of cyberwarfare operations, increasing targeted attacks on businesses and new, sophisticated mobile threats."

The fiscal cliff negotiations are reviving the debate about that other financial elephant in the room: Social Security.

Under current government estimates, Social Security could face funding shortfalls in about two decades if nothing changes. That?s because the U.S. population is aging -- and generally living longer.

That sounds like a disheartening scenario for workers who are currently paying into Social Security and worry that they won?t get as much out of it once they retire. ?About half of the Americans polled by Pew Research Center earlier this year believe it?s not likely there will be enough money in Social Security and Medicare to maintain current benefit levels into the future.

But experts say there are ways to fix Social Security. Politicians just may not like trying to sell those changes to the American people.

It has happened before, though. In the mid-1980s, none other than President Ronald Reagan, working with Democrats in Congress, oversaw a major overhaul of the nation?s retirement safety net.

That?s something many say seems less likely these days.

?There are politicians ? and especially in the Senate but also in the House as well ? who could work together and come to an agreement,? said Alan Auerbach, a professor of law and economics at the University of California, Berkeley. ?But they?re not the majority of Congress.?

Experts say there are two ways to fix Social Security, and neither of them are pretty: reduce benefits or increase revenue.

Reduce benefits
One of the few parts of the fiscal cliff negotiations that President Barack Obama and House Speaker John Boehner seem willing to compromise on involves a change in the way Social Security increases are calculated going forward.?

The proposed switch to calculating cost of living increases using the chained Consumer Price Index instead of the current method would result in smaller annual Social Security raises. That?s because that method assumes that people change their spending habits when prices go up.

Proponents say the switch could save billions and is a more realistic method of how Americans really adjust to rising prices.

But opponents say the chained Consumer Price Index isn?t a good way to measure the needs of older and disabled Americans, because their expenditures are disproportionately focused on things like health care. A family of four may choose to eat more chicken if beef prices go up, but an elderly person can?t easily choose to spend less on heart medicine, they argue.

??It?s the biggest hit on the people that couldn?t take it,? said Dean Baker, an economist with the liberal-leaning Center for Economic and Policy Research who is opposed to the measure.

One of the longer-term options for reducing benefits is to simply tell people they have to wait longer to get their full benefits. By extending the age at which you can get full benefits, proponents argue that Social Security would be keeping up with trends toward longer life expectancies.

But opponents, including CEPR?s Dean Baker, say that a closer look at the data shows that the bulk of improvements in life expectancies have come from wealthier Americans. They say a broad-based increase in the age at which people can get benefits would punish less wealthy Americans, who haven?t seen such big life expectancy gains.

Andrew Biggs, resident scholar with the conservative-leaning American Enterprise Institute, argues that another option would be to dial down benefits for middle- and high-income people while maintaining the current system for the poorest Americans.

Biggs argues that if wealthy people are told to expect less Social Security, they have more leeway to prepare for it than poor people.

?If you cut my Social Security benefits I?m going to react by saving money and working longer,? he said. ?That?s good for the economy.?

Another option would be to reduce the Social Security benefits available to spouses. Some critics argue that?s growing outdated now that more women work and earn their own Social Security payments.

?It?s kind of a relic from a different era,? Baker said.

Increase revenue
Under the current rules, the maximum taxable earnings for Social Security in 2012 is about $110,000. Some argue that an easy fix would be to simply raise the cap on Social Security taxes to include higher wages.?

Baker, of CEPR, proposes raising the cap to around $190,000, reflecting the growing wealth at the top of the income scale. Raise it higher than that, he said, and wealthy earners will just start finding ways to dodge it.

But others say that it?s unlikely politicians will propose raising taxes on high earners?now, when many expect those taxpayers to already see increases as part of the fiscal cliff negotiations.

?The timing of it just seems kind of awkward,? Auerbach said.

Another option would be to add an across-the-board increase in payroll taxes that go toward Social Security. Although that would help solve the system?s future funding woes, experts say it?s also likely to be a hard sell in these tough times.

For one thing, Americans may?already be facing higher payroll taxes?in 2012. For the past two years, Americans have enjoyed a payroll tax holiday that reduced the amount of money they paid toward Social Security, but that could end in the coming year.

?I suspect that?s going to be a not very attractive option right now,? Auerbach said.

Politicians may be nervous about proposing any reform to Social Security that costs more or results in fewer benefits, but Americans seem to accept that some changes are needed.

About 66 percent of those polled by Pew Research Center said they would support raising payroll taxes on high-income earners, while 55 percent said they would support reducing benefits for high-income seniors.

Just 38 percent said they?d support raising the eligibility age.

Health And Fitness Journal How Diet and Supplements Can Help ...

An estimated 26 million Americans suffer with migraines. Approximately 80 percent of them are women. All in all, about one in five women get migraines while only one in 16 men get them, according to migraines.org.1 About 60 percent of women affected have menstrual-related migraines, meaning it tends to coincide with their menstrual cycle.

A migraine headache is characterized as an intense throbbing or pulsing headache, typically in one area or side of your head, and is commonly accompanied by nausea, vomiting, and extreme sensitivity to light and sound.

Those who have never had a migraine before can be very frightened with the neurological symptoms. The visual problems are most problematic as a migraine can simulate a stroke where you start to have disturbed vision and even short term visual loss and flashing lights.

Migraine attacks can cause debilitating pain for several hours to several days. Some migraineurs experience ?aura? sensations before an attack. These are sensory warning symptoms, such as flashes of light, blind spots, or tingling in your arm or leg.

The featured article2 recently brought up the dietary links to migraines ? specifically how the grain- and dairy-free Paleo diet appears to help banish the pain for many people. This is not entirely surprising, considering that milk and wheat are two major food allergens.

Are Food Allergies Causing Your Migraines?

Searching the medical literature in PubMed.gov using the search terms ?migraine? and ?food allergies? will provide you with more than 150 different studies.3 Some of the top migraine-inducing foods identified include:

Processed foods in general can also contribute to allergies for a number of different reasons, and most processed foods contain a variety of food colorings, flavors, preservatives, and other additives that may also promote headaches and migraines. Both aspartame and MSG are notorious for causing headaches and triggering migraines. Besides noting whether or not your migraines typically occur after eating a specific food, additional questions that can help you determine whether or not you might have a food sensitivity or allergy are:

  • Do you experience bloating after meals, gas, frequent belching, or any kind of digestive problems?
  • Do you have chronic constipation or diarrhea?
  • Do you have a stuffy nose after meals?
  • Do you have low energy or feel drowsy after eating?

If you answer yes to any of these questions, you may want to investigate further. Keeping a detailed food diary is the easiest way to start tracking down potentially migraine-inducing foods, as well as foods that cause other symptoms of sensitivity. Keep in mind that eliminating your migraines is not the only health benefit you can reap from identifying food allergies or sensitivities. Eliminating food antigens is also critical for gut health. I?ve written extensively on this topic, as medical science is now beginning to realize just how important your gut is, not just for physical health, but emotional and psychological health as well.

Elimination Diets Shown Helpful in Reducing or Eliminating Migraines

In a 1979 study published in the Lancet,4 60 migraineurs with food antigen immunoreactivity who were put on an elimination diet experienced profound relief. According to the author:

?The commonest foods causing reactions were wheat (78 percent), orange (65 percent), eggs (45 percent), tea and coffee (40 percent each), chocolate and milk (37 percent) each), beef (35 percent), and corn, cane sugar, and yeast (33 percent each).

When an average of 10 common foods were avoided there was a dramatic fall in the number of headaches per month, 85 percent of patients becoming headache-free. The 25 percent of patients with hypertension became normotensive. Chemicals in the home environment can make this testing difficult for outpatients. Both immunological and non-immunological mechanisms may play a part in the pathogenesis of migraine caused by food intolerance.?

A randomized, double blind, cross-over study published in 20105 also found that a six-week long diet restriction produced a statistically significant reduction in migraines in those diagnosed with migraine without aura. If you notice your migraines start up shortly after eating a specific food, then that?s a good place to start. Keep in mind that you can also be sensitive to food additives like artificial colors, preservatives, flavor enhancers (MSG), and aspartame so read the food labels, and note the ingredients in your food journal.

One of the best things you can do if you believe you are suffering from a food allergy is to do a diet elimination challenge. Simply remove all foods that contain what you believe you are allergic to and see if your symptoms improve over the next several days. Keep in mind that depending on your typical migraine frequency, you may need to avoid the suspected food for a few weeks in order to evaluate whether it had an effect or not.

To confirm the results, you?ll want to reintroduce the food or drink (on an empty stomach). If the suspected food is the culprit you will generally be able to feel the allergy symptoms return within an hour, although migraines can sometimes have a longer lag time than, say, bloating or drowsiness.

Diet for Migraine Relief

Quite a few people report ridding themselves of migraines on the Paleo diet, which can be summarized as ?any food that can be eaten without being processed.? That means no grains, bread or pasta, and no pasteurized dairy, but does include lots of fresh fruits and vegetables, some nuts and oils along with wild caught fish, organic poultry and grass-fed lean meats. You can easily mold your diet around the principles of Paleo eating by following my nutrition plan. The full details are described in the plan, but generally speaking, the following key factors apply to any ?healthy diet?:

  • Eliminate all gluten products
  • Eliminate the other 10 common foods that the Lancet study found helpful in making 85 percent of participants headache free
  • Eliminate all artificial sweeteners, especially aspartame. My sister is one of many who will get a guaranteed migraine if she consumes any aspartame. Obviously, even if you don?t have migraines, there simply is no reason to ever consume aspartame
  • Unprocessed whole foods
  • Often raw or only lightly cooked (ideally, try to eat at least one-third of your food raw, or as much as you can manage)
  • Organic or grass-fed, and free from additives and genetically modified ingredients
  • Come from high-quality, local sources
  • Carbohydrates primarily come from vegetables (except corn and potatoes, which should typically be avoided). Dramatically lowering your intake of non-vegetable carbs could improve leptin and insulin signaling which could also improve migraines

I believe a return to ?real food? is one of the most profound interventions for the 21st century. We?ve strayed so far from the foods we are designed to eat, going back to basics and refocusing your diet on fresh, whole, unprocessed, ?real? food can improve just about anyone?s health, regardless of what health issues you need to address.

Helpful Supplements and More

In terms of supplements that might be helpful for migraines, one of the most critical is ubiquinol (the reduced form of Coenzyme Q10). According to experts like Dr. Robert Barry, an underlying problem involved with migraines is mitochondrial dysfunction. Ubiquinol plays a vital role in ATP production, which is the basic fuel for your mitochondria. Your body does produce ubiquinol naturally, in fact it is the predominant form in most healthy cells, tissues and organs, however, with rampant pollution and poor diet, mitochondrial dysfunction has become increasingly common.

A 2005 study published in Neurology6 found that CoQ10 was superior to a placebo in preventing migraines and reducing severity. Of the patients who received 100 mg of CoQ10 three times a day, 50 percent reported significantly reduced frequency of headaches compared to only 14 percent of those who took the placebo. Ubiquinol is the reduced form of CoQ10, and studies have repeatedly demonstrated that it is far more effective than CoQ10 due to its superior bioavailability.

Other dietary supplements that can be helpful for migraines include:

  • Magnesium. This is probably the most important one as it contributes to relaxing the brain blood vessels that cause the pain. The best magnesium supplement I know of is magnesium threonate as it penetrates cell membranes, including the mitochondria, and no other magnesium supplement does this. Interestingly, some of the best drugs used to treat migraines are calcium channel blockers, and that is how magnesium works. Supplemental magnesium would be FAR safer than a calcium channel blocker
  • Vitamin B2 (riboflavin)
  • Vitamin B6
  • Vitamin B12
  • Folic acid

A 2009 study7 evaluated the effect of 2 mg of folic acid, 25 mg vitamin B6, and 400 micrograms of vitamin B12 in 52 patients diagnosed with migraine with aura. Compared to the placebo group, those receiving these supplements experienced a 50 percent reduction in migraine disability over a six-month period. Previous studies, such as a 2004 study in the European Journal of Neurology,8 have also reported that high doses of B2 (riboflavin) can help prevent migraine attacks.

Patients received 400 mg riboflavin per day. Headache frequency was reduced from four days per month at baseline to two days per month after three months. Headache duration and intensity did not change significantly however. Keep in mind that prophylactic supplement regimens may take several weeks to produce results, so don?t give up too soon. Typically, if the supplement is the right one, you?ll notice results in about three to six months.

Exercise is something that should also be considered as an enormously useful strategy.

Last but not least, the Emotional Freedom Technique (EFT) often provides results for migraine headache relief. Newcomers who use this simple process by themselves tend to achieve relief 50 percent to 80 percent of the time. EFT is a very profound intervention that can be used in addition to the above strategies, it can also be useful for helping compliance to the lifestyle changes recommended.
