TBILISI, DFWatch ? A new report by Transparency International Georgia (TI) shows that the country?s health insurance system has major flaws.

The study shows that there are mistakes when lists of beneficiaries of insurance programs are being worked out.

The government will spend 174,1 million lari on the insurance system in 2012. But the study shows that the government is failing to calculate the cost of insurance programs, which creates problems later on.

In addition, there is no health care quality assurance and monitoring system.

The report also notes that the State Audit Service has found names of the same people listed twice, as well as dead people listed as insured.

The result of these errors is a massive waste of money ? the government has lost over one million lari, or about USD 600 000, TI estimates.

Among those who benefit from the state insurance system, 20% have salaries above 300-400 lari, which means that they should not be beneficiaries of the insurance system at all.

The study also focuses on another problem: a significant part of Georgia?s hospitals are managed by insurance companies or their subsidiaries, and not by independent companies.

TI presented a study on this subject in July, which showed that three pharmaceutical companies, controlling almost the entire Georgian pharmaceutical market are trying to be leaders on the insurance market too.

But the study is not only pointing out areas of government waste. It also shows that those who receive state insurance are unable to buy medication at a vendor of their own choosing.

The survey showed that the insurance company Alpha, which is a subsidiary of the pharmaceutical company Aversi, is making beneficiaries buy medication only in Aversi outlets.

Having identified areas of concern, TI also made the recommendation that hospitals should be managed by independent companies, not insurance companies or their subsidiaries.

HBT: D-backs acquire 3B Johnson from Astros

From MLB.com?s Brian McTaggart?comes word that the Astros have acquired offensive prospects Bobby Borchering and Marc Krauss from the Diamondbacks for third baseman Chris Johnson.

At first glance, it?s another crafty deal for Astros GM Jeff Luhnow. Johnson had a nice showing in his first real chunk of major league playing time back in 2010, but the 27-year-old owns a .314 career on-base percentage and he doesn?t play great defense.

Borchering, meanwhile, has slugged 61 home runs in his first 394 major league games. The 21-year-old third baseman and corner outfielder was the 16th overall pick in the 2009 MLB Amateur Draft. Krauss, a second-round pick in that ?09 draft, has a .924 OPS and 15 homers in 434 plate appearances this year in Double-A. He has a slugger?s profile.

Johnson will take over as Arizona?s primary third baseman. Ryan Roberts was recently traded to the Rays.

Passive investing in stocks based on market cap :: Asset Allocation ...

One can passively invest one's whole stock portfolio based exclusively on market capitalization. The total market cap of a stock is price times the number of shares issued. For example, the percentage of the entire stock portfolio devoted to Microsoft would be the market value of all of Microsoft stock divided by the market value of all publicly traded stock in the world.

One way of passively investing one's stock portfolio exclusively by market cap is to place the entire stock portfolio in one broad index fund with both U.S. and foreign stocks. (Stock indexes weighed by market cap.)

An alternative to strict adherence to market cap is investment in several index funds (different slices of the stock universe) with automatic periodic rebalancing. For example, among the many stock index funds available are:

  • S & P 500 (large cap)
  • Midcap
  • Small-cap
  • European
  • Pacific
  • Emerging markets
  • Growth
  • Value

With an investment in several of these specialized index funds, one must decide the initial percentage of the stock portfolio to allocate to each fund. After making this initial decision, one can adhere to these percentages through automatic periodic rebalancing. That forces selling high and buying low.

To illustrate, suppose because of stock price changes, the Pacific Stock Index Fund comes to constitute a lower percentage of the portfolio than initially targeted, and the European Stock Index Fund is a higher percentage than target.

Automatic periodic rebalancing to target percentages forces one to sell the European Stock Index Fund (at a ?high? price) and purchase the Pacific Stock Index Fund (at a ?low? price).

(Rebalancing does involve transaction costs; the optimal interval between rebalancing is a complex question not addressed here. Also, I shall assume the investor does not engage in tactical asset allocation.)

Automatic rebalancing and index fund investing are both ?passive? strategies in that the stock portfolio is on auto-pilot. Nevertheless, the two approaches are different. Indeed, a tension exists between them.

In contrast to automatic rebalancing, strict adherence to market cap generally forces the investor into a ?momentum? approach: increasing investment in stocks appreciating in value.

To illustrate, assume a universe of only two stocks: X and Y, with equal market cap.

The investor buys of an index fund that weights by market cap.

This results in a portfolio that is 80% in X and 20% in Y.

By staying put in a market-cap-weighted index fund, the investor has increased investment in the appreciating stock and decreased investment in the falling stock ? although there is not necessarily any reason to think that these stocks will continue to rise and fall, respectively.

A ?momentum? investor (who believes that stock price trends tend to persist) would be delighted with a portfolio that is now 75% in the appreciating stock X.

On the other hand, an investor who has opted for periodic automatic rebalancing would sell X and buy Y to restore the original 50/50 allocation, thereby selling X ?high? and buying Y ?low, ? somewhat like a contrarian active investor.

(Even within a specialized index fund, stocks that appreciate will constitute a larger percentage of the portfolio. That will please momentum investors and displease contrarians.)

To provide a simple illustration, suppose one investor chooses to invest its entire stock portfolio in a total stock U.S. market index fund (perhaps one that mimics the MSCI U.S. Broad index). Another investor decides to invest its entire stock portfolio as follows: X% U.S. large-cap index fund (perhaps an S&P 500 fund), Y% U.S. midcap index fund and Z% U.S. small-cap index fund. X%, Y% and Z% reflect the current relative market caps of those three categories. The second investor also decides to rebalance to those ratios once a year.

The two investors will start with roughly equivalent stock portfolios. Assume that after a year, the large-cap index increases 20%, and the midcap and small-cap indexes each decrease 20%.

The first investor will stay put. To rebalance back to the initial ratios, the second investor will sell some of the large-cap index fund and buy more of the midcap and small-cap index funds. The portfolios of the two investors will diverge.

In advance, it is impossible to know for certain which investor will do better over time. Nevertheless, the periodic rebalancing has the advantage of forcing the second investor to sell ?high? and buy ?low.?

(Even if one's entire stock portfolio consists of just a single comprehensive stock index fund, one can automatically periodically rebalance among stocks, bonds, and ?alternative? assets. This broad rebalancing would still provide a benefit. Nevertheless, the investor would lose the advantage of rebalancing among specialized stock index funds.)

In short, an investor has the choice between (1) one comprehensive stock index fund that weights by market cap or (2) several more specialized stock index funds. The latter permits more automatic periodic rebalancing to target percentages.

A tension exists between rebalancing and weighting by market cap.

PALMER PARK, Md. (AP) ? A week after the Colorado movie theater massacre, a Maryland man was taken into custody when police said he made a "joker" reference and threatened to shoot up a business he was being fired from.

Neil E. Prescott, 28, had an arsenal of guns, though it wasn't clear how serious he was about threats he made to his boss over the telephone, authorities said. When police questioned Prescott at his apartment, authorities said he was wearing a T-shirt that said "Guns don't kill people. I do."

Prescott told a supervisor at software and mailroom supplier Pitney Bowes that he wanted to see his boss' "brain splatter all over the sidewalk," according to police and an application for a search warrant.

"I'm a joker and I'm gonna load my guns and blow everybody up," Prescott said, according to the document.

The threats were made in two separate phone calls this week, and investigators who searched Prescott's apartment Friday morning found several thousand rounds of ammunition and about two dozen semi-automatic rifles and pistols. The weapons so far appear to have been acquired legally but are still being examined, said Mike Campbell, a spokesman for the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Prescott was taken into custody at his apartment Friday and was receiving a psychiatric evaluation at a hospital. He has not yet been charged.

"We can't measure what was prevented here, but what was going on over the last 36 hours was a significant incident in the county. And we think a violent episode was avoided," said county police Chief Mark Magaw.

The workplace Prescott is accused of threatening to shoot up is located just outside Washington.

It wasn't immediately clear when the threat was to be carried out, but last week's mass shooting during the latest Batman movie ? coupled with the "Joker" reference ? put police on edge and gave the comments extra urgency.

Though there's no other indication of a link to the Colorado shooting, police believe the joker comments were a "clear reference" to the killings, the warrant said. The man accused in those shootings, James Holmes, had his hair dyed reddish-orange, and called himself the Joker, New York Police Commissioner Ray Kelly has said.

It was not immediately clear if Prescott had a lawyer. He did not appear to have a criminal record in Maryland.

A search for Neil Prescott on a website that tracks users' online activities led to a profile that appears to be him on mdshooters.com, a website for gun enthusiasts. On it, Prescott, who used an online tag of slog403 and identified himself as from Crofton, traded advice with other users about obtaining firearms.

During a conversation last week about acquiring a 30-round magazine, he indicated he would "never violate MD laws as I respect this site and state." But in a July 18 post, he also said he wished to "unleash 30 rounds of hell" and added a smiley face emoticon. It wasn't clear what he was referring to.

Police on Thursday made an initial visit to Prescott's home, where he appeared groggy and was wearing the T-shirt with the reference to guns.

"The multiple threats and the nature of the threats and that action, together, led us to a place where we could get an emergency petition" for a psychiatric evaluation, said Deputy Police Chief Henry Stawinski.

According to the search warrant application, Prescott made the threat during a phone call on Monday morning when a supervisor contacted him on a work-related matter, then made similar statements in a separate conversation about 15 minutes later. During the call, Prescott acknowledged it was "kind of foolish of me" to say this over the phone, the supervisor told authorities.

The supervisor was aware of Prescott's arsenal and the comments "made him feel fear for his life," police said in the warrant application. The document said Prescott had been fired after working at Pitney Bowes for at least three years, but police said Friday he was in the process of being terminated.

Pitney Bowes spokeswoman Carol Wallace said in a statement that Prescott was an employee of a subcontractor to the company and had not been on any Pitney Bowes property in at least four months.

Toying with the idea of picking up a keyboard-dockable Windows 8 slate? Take your pick -- since Computex (and Microsoft's own Surface unveiling), these devices have popping up like wildflowers -- and one of them may have just slipped through federal inspection. A recent FCC filing reveals an ASUS branded tablet bearing the mark of Windows 8. The feds out the device as the TF600T, an unannounced product that sounds suspiciously similar to the Tablet 600 ASUS trotted out at Computex. Further investigation only revealed a standard radios -- Bluetooth, WiFi and NFC -- but the Transformer-like model number and Windows logo have our attention. Is this the Tablet 600? Dane Cook jokes about 'Dark Knight' shootings

Comedian Dane Cook took the stage at the Laugh Factory in Los Angeles Thursday night and joked about the massacre at?an Aurora, Colo.,?movie theater less than a week after it happened.

The shootings left 12 dead and 59 hurt at a midnight screening of the new Batman film "The Dark Knight Rises."

"So I heard that the guy came into the theater about 25 minutes into the movie," Cook says in a clip on YouTube.?"And I don?t know if you?ve seen the movie, but the movie is pretty much a piece of crap ... yeah, spoiler alert.

"And I know that if, ya know, none of that would have happened, I'm pretty sure that somebody in that theater, about 25 minutes in, realizing that it was a piece of crap, was probably like 'ugh,?(expletive) shoot me,'" Cook said.

A mix of groans from the audience turned into laughter and cheers before the audio clip ends.

Some commenters on YouTube tear into Cook for joking about the incident so soon, if at all.

"What a hack. He's trying to legitimize himself by do edgy, 'dark"' stuff, but he doesn't have the goods. Stick to your frat boy-slaying crazy dude persona, Dane," writes ChillyCheezItz.

Others defend the comedian and his right to joke about what happened.

"In his defense he was talking? about the movie sucking ... Find humor in pain. I love his comedy. Always have always will," says TheSteffeec.

Last week, Playboy model Tricia Evans beat Cook to the apparent punchline with a tweet on the same day as the shooting. "I hear the new Batman movie is really 'to die for!' Too soon?" she wrote. Deadmau5, the electronic dance musician, was among those who?later blasted Evans in a tweet of his own.?A debate over the merits of her comedy ensued and Playboy finally stepped in to make sure no one thought the magazine was writing her material.

Backlash over Cook's joke also comes on the heels of another comedian feeling the heat for what he said during a stand-up act. Daniel Tosh, of Comedy Central's "Tosh.O", apologized earlier this month after getting slammed for a rape joke directed at an audience member, also at the Laugh Factory.

Last summer, actor/comedian Tracy Morgan famously went to great lengths to calm the storm after joking about how he would "pull out a knife and stab" his son if he?was gay.

Update, 5:53 p.m. ET: Cook issued an apology on his Twitter feed, saying that he regrets telling the joke.

"I am devastated by the recent tragedy in Colorado & did not mean to make light of what happened."

"I made a bad judgment call with my material last night & regret making a joke at such a sensitive time. My heart goes out to all of the families & friends of the victims."

JustFab Just Nabbed Another $76M To Take Its Fashion Platform International And Beyond Shoes

JustFab logoAnother big round of funding in the currently-chic area of online retail and fashion: JustFab, the online shoe/fashion brand and styling platform with six million members, has raised $76 million, funding that it will use to go big on international expansion. The Series B Round was led by new investor Rho Ventures, with participation from existing backers Matrix Partners, Technology Crossover Ventures (TCV) and Intelligent Beauty, JustFab's parent company, which incubated and launched the startup in 2010. The total amount of money now raised by JustFab is $139 million. After a launch in Germany earlier this year that went "significantly better than we expected," co-CEO Adam Goldenberg tells me that the main priority right now is to continue that international expansion to one of the biggest fashion markets in Europe. "We are launching in the UK in September," he tells me, with more markets to be added by the first quarter of 2013. Currently, he says, JustFab is adding half a million users every month, and is on track to make $100 million in revenue this year -- a big leap on the $28 million of 2011 -- on a business model that mixes a subscription-based user-base with other users buying a la carte.

Before the question can be asked regarding whether current players care about former players, the first question is whether the current players even know who the former players are.

Earlier this week, a concussion lawsuit led by former Raiders quarterback Ken Stabler pointed to the fact that the league?s Super Bowl XLVI commercial regarding decades of changes to the rules fails to mention ?how recidivist violators like James Harrison (who has had five illegal hits on quarterbacks in three seasons) are allowed to continue to play the game.?

We noticed that language, appearing at paragraph 145 and page 65 of the 209-paragraph, 80-page complaint, we mentioned it, Alan Robinson of the Pittsburgh Tribune-Review repeated it, and Harrison was asked about it on Thursday by Tim Benz of WXDX radio.

Here?s the relevant exchange.

Benz:? ?James, are you aware of the story about the lawsuit mentioning your name in Philadelphia and if so what?s your reaction to it??

Harrison:? ?I?m not aware of it.?

Benz:? ?Ken Stabler and some of the other former pro football players in a concussion suit referenced you as a guy that was a repeat offender and maybe should be out of the game.? When you hear former players say that about you ??

Harrison:? ?Who is ? Ken who??

Frankly, Stabler?s opinion shouldn?t matter to Harrison.? But it?s a little surprising that Harrison has never heard of the guy.

We realize that plenty of the men who play pro football aren?t passionate fans of the game.? And we don?t expect football players to be football historians.? But for a key member of the Steelers to not know the name of a Super Bowl-era quarterback who won a Super Bowl and who played quarterback in some of the most celebrated games in Steelers history is a little strange.

Then again, if Ken Stabler?s opinion doesn?t matter to Harrison, mine definitely doesn?t.

Hopes for ECB action help European markets

LONDON (AP) ? European stocks recovered Thursday as hopes for central bank action to ease the financial crisis tempered worries that the economic downturn is hurting corporate earnings.

Markets have been rattled over the past few days by fears that Spain, the fourth-largest economy among the 17 states that use the euro, could need a bailout along the lines of Greece, Ireland and Portugal.

Markets recovered somewhat on Thursday on reports that European Central Bank President Mario Draghi told a conference of investors in London the bank could intervene in markets to bring down the government borrowing rates.

After trading lower, Germany's DAX was up 0.1 percent at 6,410.25 while France's CAC 40 was 1 percent higher at 3,112.45. Britain's FTSE rose 0.5 percent to 5,523.28. The euro rallied to trade 0.5 percent higher at $1.2214.

Wall Street was expected to open higher, with both the Dow and the S&P 500 futures up 0.4 percent.

Borrowing rates for Spain and Italy fell following the ECB President's remarks. The yield on Italy's 10-year bond dropped to 6.35 percent. Madrid's main interest rate, however, remains unsustainably high at 7.21 percent.

Marc Ostwald, an analyst at Monument Securities, welcomed Draghi's comments that high borrowing rates could hurt the bank's efforts to control inflation. Market-watchers took that as a signal that the ECB could be more willing to intervene in markets to lower those borrowing rates ? which the bank has in recent months said is not part of its mandate.

"They hint at a possible attempt to circumvent the restrictions on outright government bond purchases," said Ostwald.

Market sentiment had also been given a boost already on Wednesday, when ECB policymaker Ewald Nowotny suggested that Europe's bailout fund could be given a banking license. That would give it the ability to borrow money from the ECB. Such a move would be of particular significant for Spain and Italy as the current bailout fund does not have enough money to rescue them both.

Draghi's comments helped offset mostly gloomy news from corporate earnings. Major companies like engineering group Siemens and carmaker Volkswagen warned that the economic slowdown in Europe would hurt profits in coming quarters. That hurt stocks in the industrial and automotive sectors.

Siemens shares were down almost 4 percent while Volkswagen fell 2.3 percent. Telecommunications maker Alcatel-Lucent suffered an 8.6 percent drop. Oil company Shell, which reported lower profits, saw its shares fall 3.1 percent.

Consumer goods maker Unilever was a bright spot, gaining 4.7 percent after reporting a strong rise in profits. But its improvement in business was due to growth outside of Europe, where sales in fact fell.

Earlier in Asia, indexes mostly rose, though gains were kept in check by more evidence of the toll that Europe's prolonged debt crisis is taking on the region. South Korea, Asia's fourth-largest economy, said economic growth slowed to a two-year low in the second quarter as weakness in Europe crimped demand from South Korea's biggest market China.

Japan's Nikkei 225 stock average climbed 0.9 percent to 8,443.10 and Hong Kong's Hang Seng added 0.1 percent to 18,892.79. South Korea's Kospi gained 0.7 percent to 1,782.47. Australia's benchmark rose 0.6 percent to 4,147.70 while the Shanghai Composite shed 0.4 percent to 2,126.

In energy trading, benchmark crude for September delivery was down 12 cents at $88.85 a barrel in electronic trading on the New York Mercantile Exchange. The contract rose 47 cents on Wednesday in New York to end at $88.97.

(AP) ? Cole Hamels and the Philadelphia Phillies have agreed to a $144 million, six-year contract that prevents the 2008 World Series MVP from becoming a free agent after the season.

The deal includes a club vesting option for 2019 and a limited no-trade provision, the team announced Wednesday in a statement.

A news conference is scheduled for noon before the game against Milwaukee.

It's the largest contract signed by a Philadelphia athlete and second-highest for a pitcher behind the $161 million deal the New York Yankees gave CC Sabathia in December 2008.

The 28-year-old Hamels becomes the third Phillies starter making $20 million per season, joining Roy Halladay and Cliff Lee. A three-time All-Star, Hamels passed up an opportunity to possibly get more money on the open market to stay with the team that drafted him in 2002.

The lanky lefty is 11-4 with a 3.23 ERA this season. He's 85-58 with a 3.38 ERA in seven years in Philadelphia. Hamels has never won more than 15 games in a season, and his 2.79 ERA in 2011 was the only time he was under 3.06.

Hamels reached the majors in 2006 after battling injuries in the minors. He went 15-5 with a 3.39 ERA in his first full season in 2007, establishing himself as the team's ace and helping the Phillies win the first of five consecutive NL East titles.

He was the team's ace in '08 when he went 4-0 with a 1.80 ERA in five postseason starts. Hamels was MVP of the NLCS against Los Angeles and helped the Phillies beat Tampa Bay in five games for their second World Series title in franchise history.

Hamels struggled in 2009.

He was just 10-11 with a 4.32 ERA that year, and pitched poorly in the postseason as the Phillies tried for a repeat. Hamels was passed over for veteran Pedro Martinez to start Game 2 of the World Series at hostile Yankee Stadium. Hamels then blew a 3-0 lead in a pivotal loss in Game 3, and New York took the series in six games.

Following the additions of Halladay and Lee, Hamels went from ace to No. 3 starter. He began 2011 as the No. 4 starter behind Halladay, Lee and Roy Oswalt. There's no doubt that Hamels is the team's best pitcher this season ? and now richest, too. Halladay is 4-5 and Lee is 1-6.

The Future of American Business | Crooks and Liars

Even though this administration has done a great many things to help business over the last 3 plus years, President Obama is criticized angrily by Republicans, some members of the business community, and even some Democrats for not being "friendly enough" to business. At the same time, coming from the left, Bill Scher stirred up a lot of controversy among progressives when he a wrote a guest editorial for the NYT called How Liberals Win, arguing in it that liberals could not win social progress without working in some regards with elements of the business community. Somewhere between these two controversies is a fascinating story about the future of business in American politics.

The business community itself is fundamentally split between (a) the big incumbent companies who have, in industry after industry, come to dominate the marketplace, and whose lobbyists have an iron grip on the levers of power in the federal government; and (b) up and coming entrepreneurs and struggling small businesses who are trying to gain traction and build successful enterprises in the face of the most challenging economic circumstances in many decades.

On the first side, you have either one or just a few companies controlling overwhelming amounts of the markets they are in: in banking, retail, electronics, office supplies, oil, coal, natural gas, book sales, agribusiness and food products, health insurance, cigarettes, fast food, media, several kinds of technology products, defense and aeronautics, beer, and a wide array of other areas a half dozen or less companies control over 50% of the market.

These companies have DC lobbyists who make sure their companies get tax breaks, subsidies, and most of the government procurement and contracting deals; and they have high powered legal firms who keep DOJ's anti-trust and anti-fraud divisions from paying them any mind. These companies, no matter how coddled they are by government policy makers, tend to be highly offended by any hint that the government might in any way take away their precious tax loopholes, hold them accountable, or look more closely at the way they do their business- witness the Wall Street trader who compared Obama to a Nazi for threatening to close one of his favorite tax loopholes. Or witness Wall Street bankers in general, even with Tim Geithner and Eric Holder treating them with kid gloves too much of the time, going off in a huff and moving most of their campaign contributions to the Republican side in this election.

On the other side, you have the businesses that are trying to survive and get a toehold in the marketplace in spite of the array of forces lined against them. Banking consolidation and speculation has meant the amount of loan money going out to small businesses has shrunk dramatically. Government contractors overwhelmingly go to a few big contractors who get job after job, and government procurement follows the same pattern. Job losses, the collapse in housing prices, and depressed local wages mean most small businesses don't have customers with disposable income able to buy nearly as much as they used to. Local retail stores face brutal competition from a monopolistic leviathan in Walmart. Amazon and Barnes&Noble are killing local bookstores. Local hardware stores have to compete against Home Depot.

The big incumbent mega-businesses are squeezing out the small and medium sized firms in industry after industry, and are making it tougher and tougher for innovators and entrepreneurs to even get started. In many industries, like energy, the big business incumbents are actively trying to squeeze the life out of the up and coming innovators such as the solar and wind energy firms trying to get into the marketplace.

When Scher did his NYT piece, he got criticized by some of my fellow progressives for being willing to work with corporate America and "kowtow to our corporate overlords", but Bill was just making what is an obvious point to anyone who has been in the trenches of public policy debates at the national level: progressives all by themselves can rarely pass new legislation. To pass any bill in Congress right now, you have to divide the business community and get some allies there. If the winds of change keep blowing, and Occupy-style movements are successful at fundamentally shifting the political dynamic, maybe that changes- I certainly hope so. But in the meantime, progressives are going to have to form alliances with different sectors of the business community.

Those kinds of alliances would take two forms. The first is strictly short term, on an issue by issue basis, where certain corporate interests line up with progressive interests. This is what pro-Wall Street Democrats never got when they criticized the President's campaign for raising questions about Bain. The focus on Bain has nothing whatsoever to do with being anti-business. The problem with Bain is the kind of business it did: they out-sourced and off-shored, they cavalierly laid thousands of people off, they stripped pensions and health care benefits, they loaded good companies up with bad debt, they manipulated the tax code- all in the name of short term profit. The kind of businesses Democrats should be and in many cases are supporting are those that will produce good jobs and help expand a more prosperous middle class.

Progressives should absolutely be pro-business, but the business interests we support and build coalitions with should be the kinds of businesses that build, not tear down, the middle class in this country. And when big corporate interests abuse their workers, their consumers, and the public trust in general, we should go against them every time.
